PUBLIC OFFER AGREEMENT
for ordering, purchase, and delivery of goods
This Agreement is the official and public offer of the Seller to conclude a sales contract for goods presented on the website https://platinumchetvertinovskaya.com.ua.
According to Article 633 of the Civil Code of Ukraine, this Agreement is public, meaning its terms are the same for all buyers regardless of their status (individual, company, or entrepreneur).
By placing an order, the Buyer fully accepts all terms, including payment, delivery, returns, and liability.
The Agreement is considered concluded at the moment the Buyer clicks “Confirm Order” and receives electronic confirmation from the Seller.
1. Definitions
1.1. Public Offer — a public proposal by the Seller to conclude a remote sales contract under the terms of this Offer.
1.2. Goods or Services — the items selected by the Buyer on the online store website.
1.3. Online Store — the Seller’s website https://platinumchetvertinovskaya.com.ua, created for online retail and wholesale purchases.
1.4. Seller — Sole Proprietor Olha Chetvertynivska (Tax ID 2244825902), acting in accordance with Ukrainian law.
2. Subject of the Agreement
2.1. The Seller undertakes to transfer the Goods to the Buyer, and the Buyer undertakes to pay for and accept them under the terms of this Agreement.
2.2. The Agreement is deemed concluded at the moment the Buyer completes the order and receives confirmation from the Seller.
3. Ordering Procedure
3.1. The Buyer places an order through the shopping cart or via the contacts listed on the website.
3.2. The Seller may refuse to fulfill the order if the information provided is inaccurate.
3.3. The Buyer provides full name, delivery address, and phone number; entrepreneurs also provide their tax code.
3.4. Product names, quantities, and prices are shown in the Buyer’s cart.
3.5. The Seller is not responsible for order fulfillment if the Buyer fails to provide necessary data.
3.6. The Buyer is responsible for the accuracy of the information provided.
3.7. By placing an order, the Buyer confirms acceptance of the Offer and consents to the processing of personal data.
4. Price and Delivery
4.1. Prices are set by the Seller and indicated in Ukrainian hryvnia.
4.2. After full payment, the price cannot be changed.
4.3. Delivery costs are not included in the price and are paid separately by the Buyer.
4.4. Payment methods are listed on the website.
4.5. Payment obligations are fulfilled once the funds are credited to the Seller’s account.
4.6. Ownership passes to the Buyer upon receipt of the goods.
5. Rights and Obligations of the Parties
The Seller shall:
– deliver the Goods in accordance with the order;
– keep the Buyer’s personal information confidential.
The Seller has the right to:
– change the terms of this Agreement and prices by publishing updates on the website.
The Buyer shall:
– read the terms before ordering;
– provide accurate data for delivery.
6. Returns
6.1. The Buyer may return non-defective goods within 14 days, provided the goods were not used and retain their original condition and receipt.
6.2. Refunds are made within 30 days after the Seller receives the goods.
6.3. Refunds are issued by bank transfer.
6.4. Return shipping costs are not reimbursed.
6.5. In case of defects, the Buyer has rights in accordance with the Law of Ukraine “On Consumer Protection”.
7. Liability
7.1. The Seller is not liable for damage caused by improper use of the goods.
7.2. The Parties are exempt from liability in case of force majeure (war, natural disasters, etc.).
8. Privacy and Data Protection
8.1. By providing personal data, the Buyer consents to their processing and use in accordance with the Law of Ukraine “On Personal Data Protection”.
8.2. The Seller undertakes not to disclose such information except as required by law.
9. Final Provisions
9.1. This Agreement is concluded in Ukraine and governed by Ukrainian law.
9.2. Disputes are resolved through negotiations or in court.
9.3. The Seller may amend the Agreement unilaterally by publishing an updated version on the website.
